What happens when someone has been charged with causing the death
The Coroner’s Court is not a court to ascertain blame. They are there to determine who, when, where and how a person came about their death. If there are criminal proceedings against a person/people who may have caused the death, the inquest will be adjourned until the criminal case is resolved. This is because criminal matters must be dealt with first and the Coroner will need to be told of the outcome of the court case.
If someone is convicted of murder, manslaughter or causing death by dangerous driving following a trial, the Coroner may decide there is no need to hold an inquest.
If the case is referred to the Crown Prosecution Service and the decision is made not to charge anyone in connection with the death, or if no one can be found to be charged, then an inquest will be held.
